The Committee on Roads & Transportation moves to amend the
bill on page 2, section 2, line 7, by striking all of subdivision
(3) and inserting in lieu thereof the following:
"(3) Commits the act or failure in reckless disregard of the
safety of others, and when the influence of alcohol, controlled
substances or drugs is shown to be a contributing cause to the
death, is guilty of a felony and, upon conviction thereof, shall be
imprisoned in a state correctional facility for not less than one
nor more than ten years a definite term of imprisonment of not less
than three nor more than fifteen years and shall be fined not less
than one thousand dollars nor more than three thousand dollars. A
person imprisoned pursuant to the provisions of this subdivision is
not eligible for parole prior to having served a minimum of three
years of his or her sentence or the minimum period required by the
provisions of section thirteen, article twelve, chapter sixty-two
of this code, whichever is greater."
